Terms of Service

These Terms of Service (“Terms”) govern your use of Postcard, the social-content collaboration platform operated by Social Postcard LLC (“Postcard”, “we”, “us”) at getpostcard.ai. By creating an account or using the service, you agree to these Terms. If you are using Postcard on behalf of an organization, you represent that you have authority to bind that organization, and “you” means that organization.

1. Your account

  • You must provide accurate account information and keep it up to date.
  • You are responsible for safeguarding your sign-in credentials and for all activity under your account.
  • You must be at least 13 years old (and old enough to form a binding contract in your jurisdiction) to use Postcard.
  • Workspace owners and admins control membership, roles, and content within their workspace, including inviting and removing members.

2. Acceptable use

You agree not to use Postcard to:

  • Create, store, or publish content that is unlawful, infringing, defamatory, or that you don’t have the rights to use.
  • Send spam or engage in deceptive, manipulative, or abusive publishing practices.
  • Violate the terms, policies, or community guidelines of any social network you connect — the platform rules of connected social networks (e.g. Instagram, TikTok, LinkedIn, YouTube, X) apply to everything you publish through Postcard.
  • Interfere with or disrupt the service, probe or breach its security, or access it by automated means other than our documented interfaces.
  • Misrepresent your identity or affiliation.

We may suspend or remove content or accounts that violate this section.

3. Subscriptions and billing

  • Plans. Paid plans are billed on a monthly or annual basis. Payments are processed by Stripe; your card details never touch our servers.
  • Renewal. Subscriptions renew automatically at the end of each billing period unless cancelled.
  • Cancellation. You can cancel anytime from your billing settings. When you cancel, your plan remains active through the end of the current billing period, after which your workspace is downgraded to the free tier. We don’t delete your content on downgrade, but features and limits of the free tier will apply.
  • Price changes. We may change prices with advance notice; changes take effect at your next renewal.
  • Taxes. Prices exclude applicable taxes, which you are responsible for where required.

4. Your content

You own your content. Everything your team creates or uploads to Postcard — briefs, scripts, captions, media, comments — belongs to you (or your licensors). You grant us a limited, non-exclusive, worldwide license to host, store, process, transmit, and display your content solely as needed to operate and provide the service — for example storing media, processing video, generating AI-assisted drafts you request, and publishing to the social accounts you connect. This license ends when your content is deleted from the service, except for residual copies in backups that roll off on a fixed schedule.

You are responsible for your content, including having the rights to everything you upload and publish, and for what you choose to publish to connected social networks.

5. Our intellectual property

Postcard — the software, design, features, and branding — is owned by Social Postcard LLC and protected by intellectual-property laws. These Terms don’t grant you any rights to our trademarks or software except the right to use the service as intended. Feedback you send us may be used to improve the product without obligation to you.

6. Third-party services

Postcard integrates with third-party services (social networks via our publishing partner, payment processing, optional Google Drive and Dropbox imports, optional Slack notifications, and AI providers). Your use of those services is governed by their own terms, and we are not responsible for third-party services we don’t control — including changes social networks make to their APIs or policies that affect publishing.

7. Beta status and availability

Postcard is in active development and currently offered as a beta service. The service is provided “as is” and “as available”, without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We don’t promise the service will be uninterrupted, error-free, or that any particular feature will remain available, and we may modify features as the product evolves. Keep copies of anything critical.

8. Limitation of liability

To the maximum extent permitted by law, Social Postcard LLC and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or lost business — arising from your use of (or inability to use) the service. Our total aggregate liability for any claim relating to the service is limited to the greater of (a) the amounts you paid us in the twelve months before the claim arose, or (b) one hundred US dollars ($100). Some jurisdictions don’t allow certain limitations, so parts of this section may not apply to you.

9. Termination

You may stop using Postcard and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the service (with reasonable notice where practicable). On termination, your right to use the service ends; sections that by their nature should survive (content ownership, limitation of liability, governing law) survive termination. You may request an export or deletion of your data by emailing support@getpostcard.ai.

10. Governing law

These Terms are governed by the laws of the State of [State], without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in [State], and you consent to their jurisdiction.

11. Changes to these Terms

We may update these Terms as the product and business evolve. If we make material changes, we will update the date at the top of this page and notify you by email or in the product before the changes take effect. Continuing to use Postcard after changes take effect means you accept the updated Terms.
